These Terms & Conditions (“Terms”) govern your access to and use of the website and products operated by Tradax Sdn Bhd (Registration No. 201901009750 (1319078-D)) (“Tradax”, “we”, “us”), including TradaxVOD, DaxScan AI, and Photo Finder (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. Use of Services

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to enter into paid transactions with us. You agree to use our Services only for lawful purposes and in accordance with these Terms.

2. Accounts

Where an account is required, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3. Payments

Payments for our Services are processed through licensed third-party payment gateways (including toyyibPay). By making a payment, you authorise us and our payment gateway partners to process the transaction. Prices are stated in Malaysian Ringgit (RM) unless otherwise indicated.

4. Cancellation, Refunds, and Delivery

Cancellations and refunds are governed by our Cancellation & Refund Policy. Delivery of our digital services is governed by our Service & Delivery Policy.

5. Intellectual Property

All content, trademarks, and materials on our website and Services, excluding user-submitted content, are owned by or licensed to Tradax and are protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

6. Acceptable Use

You agree not to misuse our Services, including but not limited to: attempting unauthorised access to our systems, uploading unlawful or infringing content, or interfering with the normal operation of our Services.

7. Limitation of Liability

Our Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by Malaysian law, Tradax shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the Services.

8. Termination

We may suspend or terminate your access to our Services if you breach these Terms, without prejudice to any accrued rights or obligations.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

10. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Services, the parties shall first attempt in good faith to resolve the matter through informal negotiation within thirty (30) days of written notice. If the dispute is not resolved within that period, it shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

11. Changes to These Terms

We may revise these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of our Services after such changes constitutes acceptance of the revised Terms.
